Subject: The Italian Constitutional Court has established that, with respect to European Arrest Warrant, national judges are able to refuse, in application of the principle of non discrimination, the surrender even of EU citizens residing in Italy. The decision is an important application of fundamental rights in the field of judicial cooperation, but it shows a lack of familiarity with the doctrine of interpretation in conformity.
