Title: The protection of counterlimits between principles and suggestions

Subject: In just over one year, first the Council of State and then the Constitutional Court have taken position on how to protect the counterlimits to the application of community law, adopting opposite solutions. The analysis of the two decisions offers the occasion for some brief, more general, considerations on the topic of the respect of fundamental rights in the community area, accompanied by the exam of future relations between the Constitutional Court and the Court of Justice on this subject
