The 29th January 200t the Pre-trial Chamber of the International Criminal Court pronounced its first decision on the confirmation of the charges before Trial related to Thomas Lubanga, leader of the military Group Union des Patriotes Congolaises that had operated in the Democratic republic of Congo.
The crimes Mr Lubanga is accused for are the fact of conscripting or enlisting children under the age of fifteen years into the national armed forces and using them to participate actively in hostilities (article 8.2 of the Statute).
Being crated by the Rome Conference of July 1998, the Court entered into force in 2003; its Statute has been signed by 138 States and ratified by 104. Its jurisdiction, complementary to national criminal jurisdictions, refers to the Crime of Genocide, Crimes against Humanity, War Crimes (while the issue of the Crime of Aggression is politically still pending), whether committed in the territory or by a National of a State-Party.
