Subject: The District Court, with regard to the case of four persons detained as enemies combatant in the American prison of Bagram (Afghanistan), has deemed contrary to the Constitution the application of the Military Commission Act to three of them (non Afghan citizens) and has therefore stated the possibility for them to avail themselves of the right of habeas corpus.
