Subject: The recommendation of the Parliamentary Assembly point out member States obligations as statute-barred by the ECHR in emergency situations. The Assembly stresses how ECHR's obligations exceptions are permitted as strictly required by the situation and only if that measures do not conflict with any other obligations under international law. Furthermore, member States are obliged to guarantee in any case a democratic set-up (i.e.freedom of speech and information, opposition's political role, etc) and the respect of the Rule of Law (i.e. effectiveness of the judicial system).
