Subject: The European Parliament affirmed that the ECJ rulings in the Laval , Rüffert and Luxembourg cases, which have caused significant concern regarding interpretation of directives on the posting of workers in the framework of the provision of services, demonstrate that it is necessary to clarify that economic freedoms, as established in the Treaties, should be interpreted in such a way as not to infringe upon the exercise of fundamental social rights as recognised in the Member States and by Community law, including the right to negotiate, conclude and enforce collective agreements and to take collective action. The European Parliament emphasised that freedom to provide services is not superior to the the right of trade unions to take industrial action. The two rights are contained in the Charter of Fundamental Rights of the European Union
