Subject: Also applying the Court of Strasbourg’s jurisprudence, the High Court has established that the decision of the Secretary of State for Justice to refer the case of the claimant to the analyses of the Parole Board (organ which defines the conditions for the release of a prisoner) after a period of 18 months since the last review amounts to a violation of the right to a reasonable duration of the proceeding, according to article 5(4) of the ECHR.
