Case Law T-256/07 (23/10/2008)

Type: Judgment

Authority: European Authorities: Court of first instance of the European Communities

Date: 10/23/2008

Subject: The Court of First instance, once again finding itself dealing with the inscription of the People’s Mojahedin Organisation of Iran in the list of persons subjected to measures freezing funds, dismissed the action concerning the Decision 2007/445/EC, affirming that the Council had reasonable grounds and sufficient evidence for the adoption of this Decision. It duly observed the general principle of observance of the rights of the defence laid down by the Court in its previous judgment. The Court of First instance, instead, annulled Decision 2007/868 because the Council failed to give sufficient reasons for its decision following a decision taken by a UK judicial authority to remove the PMOI from the national list of terrorist organisations.

Parties: People’s Mojahedin Organization of Iran c/ Consiglio dell’Unione europea

Classification: Justice - Art. 48 Rights of defence
