Subject: The principle of equal treatment in the EU for citizens of European Union member states (art. 12 TEC) requires that Italy's domestic procedural law be interpreted so as not to
create unjustified discrimination as to the right to issue proceedings in the European legal space.
A retaining agreement entered into abroad shall only be lawful if the statement comes from an officer whose certifying authority as granted by the legal system in question is similar to that conferred on public officers in Italy. The statement shall refer unequivocally to the acknowledgement of the identity of the undersigned and the authenticity of the signature.
