Subject: first instance once again finds itself dealing with the Ocalan case. In this case, the Court of first instance annulled the decision 2002/460/EC in so far as it concerns the PKK. The Court concluded that the applicant was not placed in a position in which it was alble to understand the reasoning by which the Council considered that the conditions, laid down in Common Position 2001/931 and in Regulation 22580/2001, concerning specific restrictive measures directed against certain persons and entities with a view to combating terrorism, had been satisfied.
