Subject: The Supreme Court, also mentioning the European Union’s Charter of Fundamental Rights, has established that the norms provided by article 40.3.3. of the Constitution (recognition of the right to life of the so-called “unborn child”) cannot be applied to embryos which have been obtained thanks to in vitro fertilization and have not been implanted in a maternal uterus.
