Subject: The Constitutional Court, also applying the Court of Strasbourg’s jurisprudence, has stated the constitutional illegitimacy of law 298/2008, in the matter of conservation of data generated and processed by electronic communication services’ providers or public providers, as well as of the modifications to law 506/2004, concerning the treatment of personal data and the protection of private life in the field of electronic communication, for violation of the rights to the respect for private and family life, to intimacy, privacy of correspondence and freedom of expression.
