Subject: The Court set aside the order of the Court of First Instance in so far as it dismissed the submissions of Ocalan on behalf of the PKK. In fact, consistency and justice require that such an organization have the right to contest its inclusion in the disputed list. The Court, instead, dismissed Vanly's application on the basis that the KNL was not individually concerned for the purposes of Article 230 EC, as interpreted by the case-law, and was not a victim of a violation of the ECHR within the meaning of Article 34. The request for a wider interpretation of Article 230 ECT, necessary to ensure an effective access to judicial review, was rejected by the Court.
