Subject: The Court, considering that, the judgments under appeal are marred by the same error in law as those relied on in Yusuf and Kadi at first instance, annulled these judgments and the regulation in so far as it freezes funds of Mr Hassan and Mr. Yusuf. The Court considered that the new regulation, amending the fund-freezing regulation, adopted by the European Commission after apprising Mr Hassan and Mr Ayadi of the grounds for their inclusion in the list, and after examining their comments, does not exclude the necessity of the judgment because it cannot be regarded as equivalent to annulment pure and simple of the contested regulation.
