Subject: The authors comment on two recent conclusions of Advocates General Maduro and Mengozzi in cases that have already provoked an ample debate not only in public opinion but also among experts, concerning the limits in the exercise of the right to strike and of collective action in relation to the freedom to provide services and freedom of establishment. The comment underlines the importance of the Charter of Nice in recognizing the nature of fundamental rights of the social prerogatives and in striking a reasonable balance between these and two classic community freedoms
