Notes & Comments (06/06/2007) - Jurisdiction, European law and search for new strategies for judges’ training
Title: Jurisdiction, European law and search for new strategies for judges’ training
Date: 06/06/2007
Subject: The establishment of Community and supranational law changes, mostly in civil law countries, the role of national judges. Judges must know the relations between the different sources of law, relations which aren’t always based on an automatic mechanism of primacy of one over the other; instead, they have to be coordinated so as to guarantee the protection of fundamental rights. Judges must know what damage can derive from an imperfect knowledge of supranational law, also because the State is considered responsible for the activity of national judges. It is necessary to find remedies to the inadequacy of the present Italian judges’ training system, through much more effective measures than the ones already experimented. The Author suggests a few.
