Title: Counterlimits in the relationship among Community and Italian law

Subject: The Author, starting from an analysis of the primacy of Community law over national law as defined by the Court of Justice’s case-law, considers the role of fundamental rights in the national and supranational legal systems, taking then into consideration the theory of counterlimits in the case-law of the Italian Constitutional Court and especially the conditions and consequences of a declaration of contrast between these and Community law.
