Subject: The European Parliament adopted a significant resolution about the Charter of fundamental rights. The Charter, although not legally binding, has nonetheless become a reference text for European courts and national courts. The European Parliament maintained that once the rigts establisched by the Charter have been incorporated in the law of the Union, they acquire binding force by virtue of the EC law. However, the European Parliament stressed the need to overcome the crisis in the constitutional process in order to establish the Charter of Fundamental Rights as legally binding and called the Commission to check the compliance of legislative proposals not only with all European and international instruments regarding fundamental rights but also with the Charter of Fundamental Rights. Finally the European Parliament stressed that a genuine fundamental rights culture in the Union requires the development of an overall system for monitoring fundamental rights, which should include the decisions taken in the field of police and judicial cooperation in criminal matters. Both the Agency for Fundamental Rights and national parliaments could play an important role.
