Subject: The Court has quashed the order to make safe, reclaim and restore the polluted site of the waste dump of the Giugliano municipality, in application of the Community principle “the polluter pays”, which ascribes the damage to the subject who is in the condition of controlling the risks, and art. 130 of the Treaty of Maastricht.
