Subject: The decision of the Constitutional Court, recalling also article 33 of the EU Charter of Fundamental Rights, found the compatibility of article 29bis of the law on the statute of State officials, where it states the right to parental leave only for biological and adoptive parents, with the constitutional principle of equality before the law: according to the Court, the exclusion, in this specific case, of foster families in the framework of a judicial measure of a placement of a minor, is not in contrast with the principle of equality in virtue of the temporariness of the placement
