Subject: The Court affirmed that although the court of the Member State in which the child was habitually resident has jurisdiction to rule on rights of custody, it may exceptionally request the transfer of the case to a court of the Member State to which the child has been removed. It is however necessary that the child have a particular connection with that other Member State, that the other court be better placed to hear the case and that the transfer be in the best interests of the child
