Subject: The decision of the Trybunał Konstytucyjny (Constitutional Court), finds the constitutional illegitimacy of article 6(1) of the ECHR, where the words “civil rights and duties” establish the right of the judge to cover a senior executive position in the Polish courts, and where the requirement of the “court established by law” allows the European Court or national Courts to ignore the Polish constitution and the decisions of the Polish Constitutional Court, to create norms – interpreting the Convention – on the procedure of appointment of judges, and to assess the conformity to the Constitution and to the ECHR of the organizational structure of the judicial system, of the jurisdiction of the courts or of acts concerning the National Council of Judges
