Subject: The Court concludes: unanimously that the applicant party can claim "victim" within the meaning of Article 34 (right of individual petition) of the European Convention on Human Rights, breach of Article 3 of Protocol No. 1 to the Convention; unanimously, non-violation of Article 3 of Protocol No. 1 (right to free elections) to the Convention regarding changes on Feb 27 2004 system of voter registration for new legislative elections of 28 March 2004; by five votes against two, non-violation of Article 3 of Protocol No. 1 in the composition electoral commissions at the relevant time; unanimously, the violation of Article 3 of Protocol No. 1 in that the voters of the districts of Kobuleti and Khulo were deprived of their right to vote and , unanimously, non-violation of Article 14 (prohibition of discrimination) in conjunction with Article 3 of Protocol No. 1.
