Firma Feryn NV According to the Court, the fact that an employer states publicly that it will not recruit employees of a certain ethnic or racial origin constitutes direct discrimination with respect to recruitment. In fact such statements strongly dissuade certain candidates from submitting their candidature and, accordingly, to hinder their access to the labour market.
