Subject: Concerning a case of social security for European migrant workers, the Court recalled that in the absence of harmonisation at a Community level, it is for the legislation of the Member State concerned to determine the income to be taken into account when calculating contributions. However, the Court highlighted that the exclusion from the tax base for social security contributions of a worker’s foreign source income cannot affect the worker’s right to receive all of the benefits provided for by the applicable legislation. It is for the national court to determine whether such is actually the case in the situation at issue in the main proceedings.
