Subject: The Court set aside the judgment of the General Court of the European Union in so far as the General Court of the European Union thereby accepted that the European Commission could refuse to ClientEarth, on the basis of a general presumption, full access to those of the studies relating to the compatibility of the legislation of various Member States with European Union environmental law which, on the date when that decision was adopted, had not led the European Commission to send a letter of formal notice to the Member State concerned and had not therefore been placed in a file pertaining to the pre-litigation stage of infringement proceedings
