Subject: According to the Court, a Member State which is not responsible for examining an application for asylum pursuant to the criteria laid down in Chapter III of regulation 343/2003 becomes responsible on humanitarian grounds. In that proceedings, the asylum seeker and his daughter-in-law were already present on the territory of that Member State and they demonstrated that the daughter-in-law of the asylum seeker is dependent on the asylum seeker’s assistance because she has a new-born baby and suffers from a serious illness and handicap.
