Subject: Four recent judgements of the Court of Justice have deeply shaken the certainties of European labour lawyers: they affirmed that the right to take industrial actions sustaining collective bargaining must be considered as limited by the freedoms of circulation of services and of establishment in the European Community law. This article examines these decisions in depth and criticizes their less convincing passages, denouncing their dangerous implications for the national industrial relations systems
