Subject: The Author examines the recent political revival of the European Social Charter, which reached its apex in 1998 with the introduction of a system of collective claims at the Council of Europe. He interprets such revival in the light of the attempt to go beyond a problem of non effectiveness, which derives both from the international nature of its duties and from the social contents of its norms. He explains the trends regarding effectiveness, with regard to the Charter, to some important Italian and European decisions and to the recent jurisprudence of the European Committee of social rights, concerning States’ responsibility, protections ratione materiae and ratione personae, indivisibility of human rights, national judges’ role.
