Subject: After the Garcia Avello judgment, the Court has to pronunce about a case of double name. According to the Advocate general, it would not be necessary any major change to German substantive law regarding names, but it would simply involve the application of the principle of mutual recognition. Therefore the Advocate concluded that the authorities of a Member State should not, when registering the name of a citizen of the Union, automatically refuse to recognise a name under which he has already been lawfully registered in accordance with the rules of another Member State, unless recognition would conflict with overriding reasons of public interest which admit no exception.
