Subject: The work examines the position of the UN in relation to terrorism focusing on the Resolution adopted by the United Nations Assembly on 8 September 2006 approving the first global action plan to counter terrorism. It points out that the EU could play a major role in the protection and affirmation of fundamental rights provided that it is able to establish a common position in the UN Security Council. The protection of fundamental rights has been a declared commitment of all administrations in recent years in the USA. However, the September 11 terrorist attacks have been interpreted and considered as an "act of war", thus justifying the suspension of these rights and guarantees for certain non-American nationals.
