Subject: The Lithuanian judges ask the Community judge if the directive n. 2003/54 implies that member States’ transposition norms should expressly provide that customers-consumers have the right to choose which electric power network – for transmission or distribution – to connect themselves to, or if, instead, it simply recognises the possibility for the customer to connect to any network which, for a reasonable price, may satisfy his need for electric power. In this last case, if such condition is met, the decision on whether the connection must be activated through a distribution or transmission network, is included in each member State’s discretionary power.
