Subject: The Court of Justice states that the Italian Republic, by keeping in force the norms provided by art. 47, paragraphs 5 and 6 of law n. 428 of 29 December 1990, which do not guarantee the workers’ rights in case of transfer of a firm whose state of crisis has been ascertained, has violated the obligations provided by Directive 2001/23/CEE.
