Title: Responsibility of the State, now a word is enough

Subject: More and more the judges of Luxemburg deal with the responsibility of the State in community law. After the establishment of the responsibility of the State as lawmaker and administrator, the Court has asserted the responsibility of the State as judge (jurisprudence Köbler, recently Traghetti del Mediterraneo). In the prejudicial case C-470/03 of 17 April 2007 A.G.M. – COS.MET srl, the Court asserted that, in certain conditions, even mere statements of a public officer can imply national responsibility.
