Subject: The document, drafted by a group of experts in labour law, teachers, magistrates and lawyers, has been sent as a contribution within the discussion related to the European Commission's green paper about the "modernization of the labour law". The document faces the "modernization" theme in the perspective of the necessary mediation between flexibility and safety within the action of all institutional and social actors of the Union. The document doesn't expressly answer to the questions of the Commission, but takes into account some advices coming from the green paper about the protection of "atypic" work, while it strongly objects to the total absence of references to the Charter of Nice and to its rules about social-economical rights and about the "new" rights, as permanent and continuous training and the basic income
