Subject: The decision against Italy is a fundamental stage of the Court of Strasbourg towards the recognition of a hard core of fundamental rights which does not allow any restrictions. In this case the Court has restated the interpretative technique that had already lead it (Court of Human Rights, decision of 7 July 1989, Soering vs United Kingdom, Series A n. 161) to the extension of the prohibition of art. 3 to proceedings not explicitly contemplated by the Convention – and among these, to extradition, expulsion and to the right to asylum.
