Title: Solemn address to the Cour de Cassation on the occasion of the opening of the judicial year on 8 January 2007

Date: 01/08/2007

Subject: After serving for several centuries to maintain and develop a society based on sovereign states dialoguing with each other, the law has for some decades now established a Community order in Europe. This is a time of movement, of a proactive and reforming law, a law helping to construct a new order desired and put into place through a set of treaties like those that have been integrated into the sovereign law state .Through fifty years of continuous development of its case-law, the French Cour de Cassation has fully implemented the European treaties and conventions signed by France and has done so in full compliance with the French Constitution. As a result, in respecting the checks and balances of the French rule of law, the Court resolves the conflicts which continue to exist between national sovereignty and the primacy of the supranational legal and judicial order.
