Subject: The case concerns the analysis of Section 2 of the Offences Against the Person Act which, for the crime of homicide, provides compulsory death sentence. According to the Court, such norm violates arbitrarily the right to life, because it does not allow to personalize the decision on the basis of the actual circumstances of the crime and is therefore in contrast with article 2 of the Interamerican Convention of Human Rights, since in fact it limits the possibility to enjoy the rights provided by the aforesaid Convention
