Subject: The case derives from a claim of the Interamerican Commission of human rights to the Court to examine the case of the kidnapping, of the torture and of the execution of two shop stewarts, who worked in a mine. The facts took place on 13 February 1989 in Lima, Peru. The Court has stated that Peru is responsible for the violation of the right to freedom, to personal integrity, of the right to life, to jurisdictional guarantees and of the right to association, rights respectively provided by articles 7, 5, 4, 8, 25 and 16 of the American Convention of human rights. The State must immediately carry out enquiries to ascertain the facts and punish those who are responsible; within six months, it must publish an official act in which it publicly recognizes its international responsibilities; it must also adopt several measures to give assistance to the victim’s relatives and it must pay the sums of money provided by the decision as compensation for the suffered material and immaterial damages.
