Subject: The case derives from a report presented by the Court to the Interamerican Commission of human rights against Ecuador. The Commission’s question concerns the killings of Mr. Wilmer Zambrano Vélez, Mr. Segundo Olmedo Caicedo and Mr. José Miguel Caicedo, who have been executed without any trial during a raid of the Army and the National Police of Ecuador.
The Court has asserted that Ecuador has violated the right to life, provided by article 4.1 of the American Convention of human rights, and the rights to jurisdictional guarantees and protection, provided by articles 8.1 and 25 of the Convention.
The State must also ascertain the facts, in order to punish those who are guilty; within six months, it must publish an official act in which it publicly recognizes its international responsibilities; it must act in order to prevent such facts from happening again on its territory; it must also pay the sums of money provided by the decision as compensation for the suffered material and immaterial damages.
