Subject: The decision has established the illegitimacy of Proposition 8, which prohibits marriages between homosexuals, because in contrast with the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the Constitution of the United States, asserting that only marriages between men and women are valid and recognized in California; the Court has also deemed irrelevant the approval by referendum of Proposition 8, stating that “fundamental rights cannot be subjected to vote”
