Subject: The Committee of Ministers of the Council of Europe encouraged Poland to continue its reforms seeking to implement a global solution to the structural problem of the excessive length of judicial proceedings criticised in many judgments of the European Court of Human Rights since 1998. The Committee expressed satisfaction with the increase in the Polish courts' budgets and staff and with the introduction, in 2004, of a domestic remedy which in principle permits parties to seek an acceleration of proceedings and to claim compensation for damages caused by their excessive length. It nonetheless encouraged the authorities to envisage further measures in this field, such as the establishment of a clear, efficient mechanism for evaluating the length of proceedings and reduction of the backlog of cases. The authorities were also asked to ensure that the new domestic remedy was fully effective notably at the pre-trial stage of criminal proceedings.
