Subject: In an interim resolution, the Committee of Ministers welcomed the reform of bankruptcy proceedings introduced in Italy in 2006 and its immediate effects remedying many restrictions of rights and freedoms criticised by the European Court of Human Rights. In this connection, the Committee noted that the reform's impact on the duration of bankruptcy proceedings must be assessed in the context of a future global solution to the structural problem of the excessive length of judicial proceedings in Italy. It pointed out that this general problem continued to exist and also affected bankruptcy proceedings, leading to various kinds of violations of the Convention, not least with regard to the right to the peaceful enjoyment of possessions. The Committee accordingly reiterated its call for action co-ordinated at the highest political level to draw up a new, effective strategy to overcome the structural problem concerned.
