Subject: The Court has stated the groundlessness of the question of constitutional legitimacy of art.12 of the law on immigration, according to the principle that freedom of emigration is provided by a constitutional norm, subject however to “obligations provided by law for general interest”, among which there is the respect of the receiving State’s law, with reference to international cooperation agreements aiming at fighting the phenomenon of clandestine migrant streams.
