Subject: The Court affirmed that the directive on the retention of data generated or processed in connection with the provision of electronic communications services was adopted on an appropriate legal basis because its provisions are essentially limited to the activities of service providers and do not govern access to data or the use thereof by the police or judicial authorities of the Member States. The Court therefore concludes that the directive relates predominately to the functioning of the internal market.
