Subject: The Court of Cassation states that article 111 of the Italian Constitution, according to which “jurisdiction is implemented through due process regulated by law”, is a precise parameter to establish if the laws are in accordance with the Constitution and gives the judge the instrument to verify the scope of any norm of the code of criminal procedure and to guarantee an interpretation consistent with the Constitution.
