Subject: This case concerns a supposed violation of the right to freedom of enterprise, caused by the exclusion from the participation to a bidding, according to a National law (Public Procurement Act), derived from Community law, for which there is a request of assessment of Constitutional legitimacy. In application of the jurisprudence of the Court of Justice, the Vabariigi Riigikohus reconstructs and specifies powers and limits of the Court in relation to the analyses of the legitimacy of Community law.
