Subject: For the first time the Court applied the en manquement procedure, following a decision of 2014 against Azerbaijan concerning M. Mammadov, politician of the opposition party. It is the first time the Court deals with such procedure, introduced in 2010, which allows the Committee of Ministers, which oversees the enforcement of judgments, to take action before the Court in order to establish whether the State violated its duties, refusing to comply with a decision of the Court. On 5.12.2017, the Committee of Ministers decided to start this procedure following the persistent refusal by the State’s authorities to release M. Mammadov, after the ascertainment of the violation of the Convention
