Subject: Federal law on salaries does not contrast with Directive 2000/78/EC of 27 November 2000, which establishes general rules for equal treatment in occupation and working conditions. Discrimination between non-married couples registered according to the Lebenspartnerschaftsgesetz (law on life in common) and married couples with regard to the purveyance of family allowances. Moreover the German Constitutional Court observes that the German judges’ jurisprudential trend corresponds to the Court of Justice’s case law with regard to the different treatment in the purveyance of family allowances between married and non- married couples (independently of sexual trends).
