Subject: The Court affirmed that EU law does not prevent a Member State from granting family benefits to posted ore seasonal workers in respect of whom it is not, in principle, the competent Member. These benefits contribute to the improvement of living standards and conditions of employment of migrant workers and contribute to facilitate the free movement of workers. However the Court clarified that EU precludes the application, of a rule of national law in so far as it involves, not a reduction in the amount of the benefit corresponding to the amount of a comparable benefit received in another State, but exclusion from that benefit.
